Terms of sale
Last updated: [date of publication]
These terms explain what you're buying from us, what we promise and what you promise. Please read them before you order. If anything is unclear, write to us at [contact email].
1. Who we are
Under One Arm is run by [Seller legal name], trading as Under One Arm.
- Address: [address]
- Email: [contact email]
- [VAT number, or remove this line while we're not registered for VAT]
In these terms, "we" and "us" means [Seller legal name] trading as Under One Arm. "You" means the person who places the order.
Who sells to you
We sell hardcovers, PDFs, gift codes and the 12-book pack. Stripe takes your payment on its own secure page, and these terms apply to everything you buy from us.
2. Who can order
You must be 18 or over to order or to make a book. Our site is for adults. Children can't have an account.
To add a child's photo, you must be the child's parent or guardian, or have their permission. You don't need to be the parent to buy a gift code.
3. What we sell
- A hardcover. A printed picture book, 21.6 cm (8.5 in) square: 24 pages for a child aged up to 5, 32 pages from age 6. It stars your child and their favourite toy.
- A PDF. The same book as a file to read on screen or print at home.
- Gift codes. A code for a book (a hardcover or a PDF), a code for 12 books, or a code for a PDF. The family uses the code to make their book when they're ready.
- The free colouring book. Every book you buy, and every book made with a gift code, comes with a free colouring book of the same story. It is a black-and-white PDF to print at home. It has no price and you can't buy it on its own.
Every book is made in our Paper and Pencil style: soft pencil lines and light watercolour washes.
We deliver hardcovers only to the countries listed at checkout. PDFs are available in the countries listed at checkout.
4. How ordering works
- You choose a story and tell us about your child and their toy.
- You add a photo of your child and a photo of their toy. We use them to draw your child and their toy (section 9).
- We make a preview. You can read the whole story and see 4 sample pages free. You can change each picture 3 times.
- You choose a hardcover or a PDF, or use a gift code.
- You see the full price before you pay, and a notice about any import taxes for your country.
- You pay on a secure page run by Stripe. We never see your card details.
Our contract with you starts when we email to confirm your order. The preview is only a guide. The finished pages may differ a little from the preview, but the story, your characters and the style stay the same.
If you don't buy, we delete your preview and its photos 30 days after your last visit. We email you 3 days before we do.
5. Prices, delivery and import taxes
- The price and any tax we must charge are shown before you pay. Delivery is free on every order.
- Prices are in the currency shown on our site for your country. We don't change a price after you've paid.
- A gift code for a hardcover includes delivery: delivery is free on every order.
- Delivery times are estimates. We can't promise a delivery date.
- Christmas: each country has its own last order date. Some routes may not arrive before Christmas. We tell you on the page before you pay.
Import taxes
Some countries charge import taxes on parcels from abroad. We don't pay these for you. You pay them to the carrier or to customs when the book arrives.
Before you pay, we show a notice for your country that says import taxes may apply. We can't know the amount, because your country sets it.
6. Personalised books and your right to cancel
Books
Each book is made for you, with your child's name and pictures. The law in the UK and the EU lets shops refuse change-of-mind returns for goods made to your own choices. Before you pay, we ask you to tick a box to show you've read this:
Personalised books are made for you, so they can't be returned because you've changed your mind. If your book arrives damaged or lost, or has a printing fault, we'll reprint it or refund you. Your legal rights are not affected.
This applies to hardcovers and PDFs. For a PDF, you also agree that we start making it straight away, and that you lose the right to cancel once we do.
If we haven't sent a hardcover to print yet, you can ask us to cancel it, and we'll refund you in full. Once printing starts, we can't stop it.
Gift codes
A gift code is not personalised until someone uses it. So you can cancel a gift code for any reason within 14 days of buying it, as long as it hasn't been used. Tell us at [contact email]. We'll refund you in full within 14 days of hearing from you, to the card you paid with.
After those 14 days, our own promise in section 8 still applies.
7. If something goes wrong
A person checks every book before we print it or send the PDF. If something still goes wrong, we'll put it right.
- Damaged or printing fault. Send us a photo of the fault at [contact email]. We'll reprint the book or refund you. You don't need to send the book back.
- Lost in the post. If your book hasn't arrived 14 days after it left the printer, tell us within 30 days after it left the printer. We'll reprint it or refund you.
- Different from what you approved. If a picture, a name or the words in the book you receive aren't what you approved before paying, tell us. We'll fix it and send a new book or file at no cost, or refund you. You don't need to send the book back.
- A fault in a PDF. Tell us. We'll fix it or send a new file. If we can't, we'll refund you.
- We can't make your book. Sometimes we can't make a book that passes our checks. If that happens, we'll tell you and refund what you paid for it. [If a gift code was used: say whether the book goes back onto the code. SPEC does not say yet.]
Please tell us as soon as you can. This doesn't limit your legal rights. Under UK law, goods must be of satisfactory quality, fit for purpose and as described. Digital files must be too. If they aren't, you have the rights the law gives you.
8. Gift codes
- They never expire. A paid gift code has no end date, in every country.
- Refunds for unused codes. If nobody has used any of the code, we'll refund it in full whenever you ask. Once we refund a code, it stops working.
- The 12-book pack, partly used. [Pending the accountant (GIFT-9). Draft formula:] If some books on a 12-book code have been used, we refund the books not yet used at the pack's price per book. That is the price you paid, divided by 12, times the number of books left, rounded down to the nearest penny. For example, if you paid £399 and 7 books are left, we refund £232.75.
- How a code works. The family signs in, makes their book and uses the code at checkout. A code for a book can be a hardcover or a PDF. A code for a PDF can only be a PDF.
- Delivery country. The family chooses the delivery country when they use the code. A hardcover is only possible if we deliver there and that country's last order date hasn't passed. If it has, they can still choose a PDF. We tell them before the code is used.
- What a code covers. A code covers the book. Family members added to the book are paid for separately when the code is used.
- Keep it safe. Anyone who has the code can use it. We can't refund a code that has already been used, even if someone else used it. You can download the card again from your account.
- Not cash. A code can't be swapped for money, except under the refund rules above.
- Privacy. Before the code is used, we never show the family your name, email or message, except what you chose to put on the card.
9. Your photos
Your promises to us
When you add a photo or type a name, you promise that:
- you're 18 or over;
- you're the child's parent or guardian, or you have their permission;
- you have the right to use each photo, because you took it or the person who did has said yes;
- you have permission from each family member whose photo you add (or their parent or guardian, if they are a child);
- your photos and words don't break the law or anyone else's rights.
If you break these promises and someone makes a claim against us, you may be responsible for our loss under the law. [Counsel: is a softer wording needed for consumers? An indemnity is deliberately left out.]
What you let us do with them
You keep all your rights in your photos. You let us use them only to make your book. That means we check them and store them. We send them to the services that help us draw your characters (see our privacy notice). Then we make the pages and print the book.
We don't use your photos, your child's name or your book for anything else. We don't use them in our marketing. We don't let anyone use them to train AI tools. We never use them to recognise faces.
This permission ends when we delete the photos (see our privacy notice for when). The book we've already made, and the copy you keep, aren't affected.
10. Your book and how you can use it
The book is for you and your family. You may keep it, read it, print copies of the PDF and share it with family and friends.
You may not sell it, or use it in advertising or for any business.
We don't promise that you, or we, own the copyright in the pictures. In many countries, pictures made with AI tools may not be protected by copyright at all. We give you every right we have to use your book as these terms allow.
Our story templates, the Paper and Pencil style, our site and our name belong to us.
11. How we use AI tools
We're open about how our books are made.
Pictures made with AI tools in our Paper and Pencil style, checked by a person before printing.
The stories come from templates we wrote. Each story is written with AI tools from that template and then checked. A person checks every book before it is printed or sent.
12. What we won't make
We may refuse a photo, a name or a message, or stop making a book, if:
- a photo doesn't clearly show a child or a toy, or isn't safe;
- a name, a description or a message is rude, hateful, sexual or violent;
- a book would copy a brand or a character someone else owns. If your child's toy is a well-known character, we draw a plain version of it, with no logos or famous faces;
- we think a photo was added without permission.
When we refuse a photo, we say: "We couldn't use this photo. Try a clearer one." We don't say which check it failed.
If we stop making a book you've paid for, we refund you.
We report suspected child sexual abuse material to the authorities [NCMEC, and the UK body counsel names], as the law requires. When we do, we close the account.
13. Reviews
Only someone who bought a book can review it, and each order has one review. We publish good reviews and bad ones alike, and we never pay or reward anyone for a review. Our review policy says what we remove, and why.
14. Our responsibility to you
- We're responsible for loss you suffer that was a foreseeable result of us breaking these terms or not taking reasonable care. Loss is foreseeable if it was obvious it would happen, or if we both knew it might when you ordered.
- We're not responsible for loss we couldn't have foreseen.
- Our books are for personal use. We're not responsible for loss of profit, business or business opportunity.
- If a file we supply damages your device or other digital content, because we didn't use reasonable care, we'll repair the damage or pay you fair compensation.
- If something outside our control delays your book, such as a strike or a carrier problem, we'll tell you and do what we can.
Nothing in these terms limits our responsibility for:
- death or personal injury caused by our negligence;
- fraud;
- anything else the law doesn't let us limit, including your rights under the UK Consumer Rights Act 2015.
15. Your account
You sign in with a link we send to your email. Keep your email account secure.
You can delete your data at any time from your account. Our privacy notice explains what this removes and what it can't, such as a book that's already being printed.
16. Complaints and contact
If you're unhappy, please tell us first at [contact email]. We'll reply within [number] working days.
17. The law that applies
These terms are governed by the law of England and Wales.
If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
If you live in another country, you keep the protection of the laws of your own country that can't be set aside by a contract. You can also bring a claim in your own courts.
18. Changes to these terms
We may update these terms. The terms you agreed to when you ordered apply to that order.
We won't change the terms in a way that takes away anything a gift code you've already bought gives you.
19. Other things
- If a court finds part of these terms invalid, the rest still applies.
- If we don't enforce a term straight away, we can still enforce it later.
- Only you and we have rights under these terms.
